Thank you for using Unpoll! These Terms of Service ("Terms") govern your use of the Unpoll website and service (collectively, the "Service") operated by ANGKEL G.P. ("we", "us", "our"), a company registered in Greece.
By using Unpoll, you agree to these Terms. If you don't agree, please don't use the Service.
We (the folks at ANGKEL G.P.) run a polling service called Unpoll. When you use Unpoll, you're agreeing to the latest Terms of Service. These Terms apply to all users of the Service, whether you're on a free or paid plan.
We don't own your data. You do. We don't sell your data to third parties, and we never will.
We may update these Terms from time to time. When we make significant changes, we'll notify you through the Service. Continued use after changes means you accept the new Terms.
You must be at least 18 years old to use this Service. By using Unpoll, you represent that you are at least 18 years of age.
You are responsible for your account. You must provide accurate information when creating your account. You're responsible for maintaining the security of your account and password. We cannot and will not be liable for any loss or damage from your failure to secure your account.
One person, one account. Accounts are for individual humans. You may not create multiple free accounts.
You are responsible for your content. You're responsible for all activity on your account and all content you create, including polls, questions, and any data you collect through the Service.
The Service is available for both business and personal use.
We trust you to use Unpoll responsibly. In exchange, you agree not to:
If we determine, in our sole discretion, that your use violates these terms, we may suspend or terminate your account.
Unpoll is designed for legitimate polling and user research purposes. To ensure a good experience for all users, we enforce fair usage limits on all accounts.
Free accounts are subject to limits on the number of polls, number of responses collected, and available features. These limits may change over time. Current limits are displayed within the Service.
Paid accounts have higher limits appropriate to the plan purchased. Specific limits are outlined at the time of purchase.
We reserve the right to suspend or terminate free accounts that have been inactive for 3 months or more, appear to be created solely to circumvent usage limits, or are used in ways that place unreasonable burden on our infrastructure.
Before terminating an inactive free account, we will attempt to notify you via email at least 14 days in advance and give you an opportunity to keep your account active.
The following terms apply to paid plans:
Paid plans are billed in advance on an annual basis (and/or monthly basis, if available). Prices are displayed before purchase and are subject to change with 30 days' notice.
Paid plans renew automatically at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current price at renewal.
If payment fails, we'll attempt to charge you again. After multiple failures, your account may be downgraded to a free plan and access to paid features will be restricted.
Prices displayed may not include applicable taxes (such as VAT), which will be calculated and added at checkout where required by law. You are responsible for any applicable taxes.
We may change our prices from time to time. Price changes will not affect your current billing period but will apply upon renewal. We will notify you of price changes at least 30 days in advance.
If you are a consumer in the European Union, you have the right to withdraw from your purchase within 14 days without giving any reason. However, by purchasing a paid plan and accessing the Service immediately, you acknowledge that the Service will be made available to you immediately upon payment, expressly consent to waive your 14-day withdrawal right once you access paid features, and acknowledge that you lose your right to withdraw once performance of the Service has begun.
This consent is requested and recorded at the time of purchase.
Outside of the EU withdrawal right described above:
No refunds for unused time. If you cancel your subscription or downgrade to a free plan, you will not receive a refund for any unused portion of your current billing period. Your access to paid features will continue until the end of that period.
No retroactive refunds. We do not provide refunds for past billing periods. Refund requests must be made within 30 days of the charge in question. Requests for refunds of charges older than 30 days will not be honored.
No refunds for account termination. If your account is terminated for violation of these Terms, you are not entitled to any refund.
If you believe you were charged in error, contact us within 30 days of the charge. We will investigate and correct any verified billing errors. Disputes raised more than 30 days after a charge may not be eligible for correction or refund.
Notwithstanding the above, we may, at our sole discretion, provide refunds or credits in cases we deem appropriate. Any discretionary refund does not entitle you or others to future refunds in similar circumstances and does not waive our rights under these Terms.
You can cancel your paid subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period—you won't be charged again, but you won't receive a refund for the current period either.
Your content is yours. You retain all rights to the polls you create and the response data you collect through the Service. We do not claim any ownership over your content.
By using the Service, you grant us a limited license to store, display, and transmit your content solely for the purpose of providing the Service to you. This license ends when you delete your content or close your account.
The Service itself—including the design, code, logos, and documentation—is owned by ANGKEL G.P. and protected by copyright, trademark, and other laws. You may not copy, modify, or reverse engineer any part of the Service.
If you send us feedback or suggestions, you grant us the right to use them without restriction or compensation to you.
Your privacy matters to us. Our Privacy Policy explains in detail how we collect, use, and protect your data and your respondents' data.
You can export or delete your polls and response data at any time through the Service.
When you delete content or close your account, it becomes inaccessible immediately. Deleted data is retained in a deactivated state for fraud prevention and service integrity. You may request permanent deletion by contacting us at [email protected]. Certain data (such as transaction records) is retained as required by law. Deleted data may also persist in encrypted backups for up to 7 years for legal compliance and dispute resolution purposes. We may retain certain data as required by law (such as tax and accounting records) or for legitimate business purposes including fraud prevention, security incident investigation, and defense against legal claims. Anonymized or aggregated data that cannot identify you or any individual may be retained indefinitely for analytics and service improvement.
We are based in the European Union and process data in accordance with GDPR and applicable EU data protection laws.
If you collect data from poll respondents, you are the data controller for that data. You are responsible for ensuring you have the proper legal basis to collect and process respondent data, and for informing respondents how their data will be used.
You can cancel your account at any time through your account settings. Upon cancellation, paid accounts retain access until the end of the billing period, then are downgraded or closed. Free accounts are closed immediately upon request. Your data is deleted according to our data retention policies described above.
We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to violation of these Terms, extended inactivity (for free accounts), fraudulent or illegal activity, requests by law enforcement or government agencies, or unexpected technical or security issues.
We will make reasonable efforts to notify you before termination, except where prohibited by law or where immediate termination is necessary to protect the Service or other users.
The Service is provided "as is" and "as available." We do our best to keep Unpoll running smoothly, but we make no guarantees.
To the maximum extent permitted by law, ANGKEL G.P. disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose, that the Service will be uninterrupted, timely, secure, or error-free, that the results obtained from the Service will be accurate or reliable, and that any errors in the Service will be corrected.
Poll results are not professional advice. The Service is a tool for collecting opinions and feedback. Poll results should not be relied upon as the sole basis for making medical, legal, financial, or other professional decisions. Always consult qualified professionals for important decisions.
To the maximum extent permitted by applicable law:
ANGKEL G.P. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.
Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the greater of the amount you paid us in the 12 months before the claim arose, or €100.
This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise), even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to indemnify and hold harmless ANGKEL G.P., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, your violation of any third-party rights, or content you create or collect through the Service.
These Terms are governed by the laws of Greece, without regard to conflict of law principles.
Any disputes arising from these Terms or the Service shall be resolved in the courts of Thessaloniki, Greece, and you consent to the jurisdiction of those courts.
If you are a consumer in the European Union, you may also be entitled to bring claims in the courts of your country of residence, and nothing in these Terms affects your statutory rights as a consumer.
We may update these Terms from time to time. When we make significant changes, we will update the "Last updated" date at the top and notify you through the Service or via email.
Your continued use of the Service after changes take effect constitutes acceptance of the new Terms. If you disagree with changes, you may close your account.
